Terms of Service

1. About Cargeaux

Cargeaux is a trade name of Hammock Holdings, LLC, a Louisiana limited liability company headquartered in Ascension Parish, Louisiana. Cargeaux ("we," "us," or "our") operates an online vehicle classified advertising marketplace at Cargeaux.com (the "Platform") that allows registered users to post vehicle listings and to contact other users regarding those listings.

Cargeaux is a marketplace only. We are not a vehicle dealer, broker, auction house, lender, or party to any transaction between buyers and sellers. We do not buy, sell, trade, inspect, title, register, transport, or take possession of any vehicle. All transactions are strictly between the buyer and seller.

2. Eligibility

You must be at least 18 years of age and a legal resident or entity authorized to conduct business in the United States to use this Platform. By creating an account, you represent and warrant that you meet these requirements.

You are responsible for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure.

3. Marketplace Platform — No Involvement in Transactions

Cargeaux does not:

• Verify the accuracy of any listing, vehicle description, photograph, mileage, VIN, title status, or condition claim made by a seller
• Guarantee the identity, creditworthiness, or legitimacy of any user
• Participate in, facilitate, escrow, process, or guarantee any payment between users
• Provide any warranty, express or implied, regarding any vehicle listed on the Platform
• Act as an agent, representative, or intermediary for any buyer or seller

You agree that Cargeaux shall have no liability of any kind arising from or relating to any transaction, communication, or interaction between users of the Platform.

4. Listing Rules and Seller Representations

By posting a listing on Cargeaux, you represent and warrant that:

• You are the legal owner of the vehicle or are authorized by the legal owner to sell it
• All information in the listing — including year, make, model, mileage, condition, title status, accident history, and photographs — is accurate and truthful to the best of your knowledge
• The vehicle is legally available for sale and is not subject to any undisclosed liens, encumbrances, or legal holds
• You will promptly remove or update the listing if the vehicle is sold, traded, or is no longer available
• You will not post the same vehicle in multiple active listings simultaneously
• You will respond to buyer inquiries in good faith

Cargeaux reserves the right to remove any listing at any time, without notice or refund, that we determine in our sole discretion violates these Terms or is fraudulent, misleading, or otherwise harmful to users or the Platform.

5. Louisiana Disaster History Disclosure — Required

Louisiana has experienced multiple major declared disaster events, including hurricanes, floods, and tropical storms. Cargeaux requires all sellers to complete a disaster history disclosure for each vehicle listed.

By completing the disaster history disclosure during listing creation, you certify under penalty of removal and potential civil liability that your disclosure is truthful and accurate to the best of your knowledge. Knowingly misrepresenting a vehicle's disaster history may constitute fraud under Louisiana law.

Cargeaux does not independently verify disaster disclosures. Buyers are strongly encouraged to obtain a vehicle history report and have the vehicle independently inspected before purchase.

6. Safety — Meetings, Test Drives, and Payments

Meeting Safety:

• Meet in a well-lit, public location — police station parking lots, bank parking lots, and busy shopping centers are recommended
• Bring a trusted friend or family member with you
• Tell someone where you are going and who you are meeting
• Never meet at your home address or an isolated location
• Trust your instincts — if something feels wrong, leave

Test Drive Safety:

• Verify the seller's identity matches the title before a test drive
• Never allow a test drive without being present or without proper insurance documentation
• Sellers: photograph the buyer's driver's license before any test drive
• Keep the test drive route short and in familiar areas

Payment Safety:

• Cash transactions should be conducted at or inside a bank during business hours
• Cashier's checks and money orders should be verified at the issuing bank before releasing the vehicle
• Be extremely cautious of overpayment schemes, requests to wire funds, or pressure to accept payment via unusual methods
• Never release a title or vehicle before payment is fully verified and in hand
• Cargeaux does not process, hold, escrow, or guarantee any payments between users

Cargeaux shall have no liability for any loss, injury, theft, fraud, or damage arising from any in-person meeting, test drive, or payment arranged through this Platform.

7. Prohibited Conduct

You agree not to use the Platform to:

• Post false, misleading, or fraudulent listings or information
• Sell vehicles with odometer rollback, title washing, or undisclosed salvage history
• Harass, threaten, or deceive other users
• Use the Platform for any purpose other than legitimate private vehicle sales or authorized dealer activity
• Scrape, harvest, or automate access to the Platform's data
• Post listings for vehicles you do not own or are not authorized to sell
• Circumvent or abuse the Platform's listing limits or plan restrictions
• Use another person's account or impersonate any person or entity
• Engage in any activity that violates federal, Louisiana, or local law

Violations may result in immediate account suspension or permanent ban without refund.

8. Listing Plans and Billing

Geaux (Free): Available to private sellers only. Limited to 3 listings per rolling 12-month period. Misuse of this tier by commercial sellers or resellers is a violation of these Terms and may result in account termination.

Geaux Pro: Available to individual sellers, resellers, and licensed dealers. Currently available at no charge during the promotional launch period. The standard rate of $2.00 per listing per month will apply once the promotional period ends. We will provide advance notice before any fees take effect.

Geaux Featured: A paid monthly subscription billed at $2.00 per listing per month through December 31, 2026, increasing to $5.00 per listing per month on January 1, 2027. We will provide advance notice before the rate increase takes effect. Listings renew on the 1st of each month. To avoid being charged for the following month, you must delete your listing before the 1st. No prorations or refunds will be issued for partial billing periods.

All payments are processed by Stripe, Inc. Cargeaux does not store your payment card information. By providing payment information, you also agree to Stripe's Terms of Service and Privacy Policy.

9. User-Generated Content

By submitting any listing, description, photograph, or message through the Platform, you grant Cargeaux a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content solely in connection with operating and promoting the Platform.

You represent that you own or have the right to use all content you submit, and that your content does not infringe any third-party intellectual property rights.

You agree to indemnify, defend, and hold harmless Cargeaux and its owners, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Platform; (b) any listing you post; (c) any transaction you enter into with another user; (d) your violation of these Terms; or (e) your violation of any third-party rights.

13. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Intellectual Property

The Cargeaux name, logo, trade dress, and all original Platform content, design, code, and features are the exclusive property of Cargeaux and its owners. Nothing in these Terms grants you any right to use Cargeaux's trademarks, service marks, or trade dress without prior written permission.

15. Termination

Cargeaux reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any violation of these Terms or for any conduct we determine to be harmful to users or the Platform. You may terminate your account at any time by contacting support. Termination does not entitle you to a refund of any prepaid fees.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Ascension Parish, Louisiana, and you consent to personal jurisdiction in those courts.

Before initiating any legal proceeding, you agree to contact Cargeaux at the address below and provide at least 30 days for us to attempt to resolve the dispute informally.

17. Changes to These Terms

Cargeaux may update these Terms from time to time. We will post the revised Terms with an updated effective date. Your continued use of the Platform after any such update constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
